(3rd\u00a0Cir. &#8211;\u00a0Delaware).<\/p>\n<p>The dispute centers around adidas&#8217; fitness tracking patents such as US8,068,858 (<em>Methods and computer program products for providing information about a user during a\u00a0physical activity<\/em>) and US7,805,150 (<em>Wireless device, program products and methods of using a wireless device to deliver services<\/em>), and US8,968,156 (<em>Methods\u00a0for determining workout plans and sessions<\/em>), among others.<\/p>\n<p>According to the complaint in this case, adidas claims that the &#8220;My Asics&#8221; mobile application, its respective desktop, website, and server software and interfaces, and associated products sold by Asics America are infringing its patents. \u00a0Moreover, Asics, acquired FitnessKeeper last year (<a href=\"http:\/\/corp.asics.com\/en\/press\/article\/2016-02-12-1\">Press Release<\/a>), which includes the fitness tracking app \u2018Runkeeper\u2019, an application that can track and record fitness activities such as running, walking and cycling through GPS on smartphone devices, which is itself accused of, for example, RunKeeper is accused of permitting its millions of users to\u00a0assign ratings to and\/or annotate fitness routes infringing the adidas patents. \u00a0The accused functionality includes &#8220;the ability to receive data from another\u00a0device, for example a heart rate monitor, and associate data from such device with other\u00a0information regarding a fitness activity.&#8221;<\/p>\n<div id=\"attachment_1004\" style=\"width: 310px\" class=\"wp-caption alignnone\"><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-1004\" data-attachment-id=\"1004\" data-permalink=\"http:\/\/www.ipmetrics.net\/blog\/litigation\/case-law\/fitness-tracking-patent-suit-adidas-v-asics\/attachment\/fitnesstracking-us8068858\/\" data-orig-file=\"https:\/\/i0.wp.com\/www.ipmetrics.net\/blog\/wp-content\/uploads\/2017\/03\/fitnesstracking-US8068858.jpg?fit=496%2C341\" data-orig-size=\"496,341\" data-comments-opened=\"0\" data-image-meta=\"{&quot;aperture&quot;:&quot;0&quot;,&quot;credit&quot;:&quot;Fernando Torres&quot;,&quot;camera&quot;:&quot;&quot;,&quot;caption&quot;:&quot;&quot;,&quot;created_timestamp&quot;:&quot;1490020386&quot;,&quot;copyright&quot;:&quot;&quot;,&quot;focal_length&quot;:&quot;0&quot;,&quot;iso&quot;:&quot;0&quot;,&quot;shutter_speed&quot;:&quot;0&quot;,&quot;title&quot;:&quot;&quot;,&quot;orientation&quot;:&quot;0&quot;}\" data-image-title=\"fitnesstracking US8068858\" data-image-description=\"&lt;p&gt;fitness tracking patent drawing&lt;\/p&gt;\n\" data-image-caption=\"&lt;p&gt;US8068858&lt;\/p&gt;\n\" data-medium-file=\"https:\/\/i0.wp.com\/www.ipmetrics.net\/blog\/wp-content\/uploads\/2017\/03\/fitnesstracking-US8068858.jpg?fit=300%2C206\" data-large-file=\"https:\/\/i0.wp.com\/www.ipmetrics.net\/blog\/wp-content\/uploads\/2017\/03\/fitnesstracking-US8068858.jpg?fit=450%2C309\" class=\"size-medium wp-image-1004\" src=\"https:\/\/i0.wp.com\/www.ipmetrics.net\/blog\/wp-content\/uploads\/2017\/03\/fitnesstracking-US8068858.jpg?resize=300%2C206\" alt=\"fitness tracking patent drawing US8068858\" width=\"300\" height=\"206\" srcset=\"https:\/\/i0.wp.com\/www.ipmetrics.net\/blog\/wp-content\/uploads\/2017\/03\/fitnesstracking-US8068858.jpg?resize=300%2C206 300w, https:\/\/i0.wp.com\/www.ipmetrics.net\/blog\/wp-content\/uploads\/2017\/03\/fitnesstracking-US8068858.jpg?w=496 496w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><p id=\"caption-attachment-1004\" class=\"wp-caption-text\">US8068858<\/p><\/div>\n<p>Curiously enough, adidas also claims Defendants had, should have had, prior knowledge of the patents in suit because of a prior action brought by adidas two years before the RunKeeper acquisition.
