{"id":148,"date":"2010-12-29T07:15:42","date_gmt":"2010-12-29T14:15:42","guid":{"rendered":"http:\/\/ipmetrics.net\/blog\/?p=148"},"modified":"2010-12-29T07:15:42","modified_gmt":"2010-12-29T14:15:42","slug":"apple-pandora-the-weather-channel-and-others-in-privacy-class-action-suit","status":"publish","type":"post","link":"http:\/\/www.ipmetrics.net\/blog\/litigation\/case-law\/apple-pandora-the-weather-channel-and-others-in-privacy-class-action-suit\/","title":{"rendered":"Apple, Pandora, The Weather Channel, and others in privacy class action suit"},"content":{"rendered":"<p>Just before Christmas\u00a0Apple, Inc, Backflip, Dictionary.Com, Pandora, Inc, and The Weather Channel were the named defendants in a class action lawsuit filed\u00a0\u00a0by Jonathan Lalo, through the KamberLaw, LLC firm. \u00a0The complaint points to the alleged responsibility of the device maker and gatekeeper of the App Store for allowing applications for the iPhone and iPad to transmit, without consent, users\u2019 personal information to advertising networks, and also names some of the prominent applications as the main perpetrators.<\/p>\n<address><span style=\"font-style: normal;\">The central allegation in this class action is the collection and sale by the accused applications of user-identifying information such as their location, age, gender, income, ethnicity, sexual orientation and political views. \u00a0Ultimately, these are claims of computer fraud and invasion of privacy. \u00a0For example, under the 1984 Computer Fraud and Abuse Act,<\/p>\n<div id=\"_mcePaste\">the unauthorized\u00a0access of a computer to obtain protected financial or credit information is a criminal act. \u00a0Other federal laws may come into play as the case develops, such as the 1986\u00a0Electronic Communications Privacy Act, the 2002\u00a0Cyber Security Enhancement Act, as well as civil penalties under the\u00a0Digital Millennium Copyright Act.<\/div>\n<div id=\"_mcePaste\"><span style=\"font-style: normal;\"><br \/>\n<\/span><\/div>\n<div id=\"_mcePaste\"><span style=\"font-style: normal;\">Mainstream media attention to this phenomenon hit a high note earlier this month when\u00a0\u00a0Scott Thurm and Yukari Iwatani Kane published their report &#8220;<\/span><a style=\"font-style: normal;\" href=\"http:\/\/online.wsj.com\/article\/SB10001424052748704368004576027751867039730.html\" target=\"_blank\">Your Apps Are Watching You<\/a><span style=\"font-style: normal;\">&#8221; on the Wall Street Journal. \u00a0Joel Rosenblatt,\u00a0writing\u00a0for Bloomberg|BusinessWeek, has also <\/span><a style=\"font-style: normal;\" href=\"http:\/\/www.businessweek.com\/news\/2010-12-28\/apple-sued-over-applications-giving-information-to-advertisers.html\" target=\"_blank\">reported on the lawsuit<\/a><span style=\"font-style: normal;\">.<\/span><\/div>\n<p><\/span><\/address>\n<address><span style=\"font-style: normal;\"><br \/>\n<\/span><\/address>\n<address>Case Info: <span style=\"font-size: xx-small;\">5:10-cv-05878-PSG<\/span> Lalo v.
