{"id":425,"date":"2011-02-24T15:55:30","date_gmt":"2011-02-24T23:55:30","guid":{"rendered":"http:\/\/ipmetrics.net\/blog\/?p=425"},"modified":"2011-02-24T15:55:30","modified_gmt":"2011-02-24T23:55:30","slug":"patent-damages-reforms-to-be-considered-next-month","status":"publish","type":"post","link":"http:\/\/www.ipmetrics.net\/blog\/economics\/economic-damages\/patent-damages-reforms-to-be-considered-next-month\/","title":{"rendered":"Patent Damages Reforms to be Considered Next Month"},"content":{"rendered":"<p><a title=\"Reuters Article\" href=\"http:\/\/www.reuters.com\/article\/2011\/02\/16\/us-patent-congress-idUSTRE71F6OR20110216\">Reuters reported<\/a> that Majority Leader Harry Reid announced that the Senate aims to begin consideration next month, possibly by March 14, of a <a title=\"PDF of  S23-RS\" href=\"http:\/\/www.gpo.gov\/fdsys\/pkg\/BILLS-112s23rs\/pdf\/BILLS-112s23rs.pdf\">bipartisan bill to revamp the U.S. patent system<\/a> and reduce the likelihood of what critics see as &#8220;excessive damage awards.&#8221;<\/p>\n<p>The two areas of damages that we are watching closely are the reforms to the False Patent Marking provisions (<a title=\"USPTO Patent Law Section\" href=\"http:\/\/www.uspto.gov\/web\/offices\/pac\/mpep\/documents\/appxl_35_U_S_C_292.htm\">35 USC \u00a7292<\/a>) and to Patent Infringement Remedies (<a title=\"USPTO Law Section\" href=\"http:\/\/www.uspto.gov\/web\/offices\/pac\/mpep\/documents\/appxl_35_U_S_C_284.htm\">35 USC \u00a7284<\/a>).<\/p>\n<h3>False Marking<\/h3>\n<p>Current law allows &#8220;Any person&#8221; to sue for the &#8220;$500 for every such offense&#8221; penalty (35 USC 292(b)) and this has created a veritable cottage industry of &#8220;patent marking chasers,&#8221; particularly ever since the $500 penalty has been applied to each item so marked, creating windfall profits to the filers (and the US Treasury).<\/p>\n<p>The proposed reform bill seeks to strike this subsection with the following language: &#8221;(b) Any person who has suffered a competitive injury as a result of a violation of this section may file a civil action in a district court of the United States for recovery of damages adequate to compensate for the injury.&#8221;  Consequently, the reform on this issue aims at limiting recovery to compensatory damages to persons with actual damages.<\/p>\n<h3>Damages Determination<\/h3>\n<p>The proposed reform includes, for Section 284 \u2013 Damages, adding a subsection specifying the procedure for determining damages whereby: (a) The court shall identify the methodologies and factors that are relevant to the determination of damages to be considered by the court or jury; (b) The parties shall specify in a timely fashion the methodologies and factors proposed for instruction to the jury in determining damages, including the underlying legal and factual bases for their assertions; and (c) The court shall also consider whether one or more of a party&#8217;s damages contentions lacks a legally sufficient evidentiary basis.<\/p>\n<h3>Further reading<\/h3>\n<p>A full summary of the bill can be obtained on the Library of Congress&#8217;\u00a0<a href=\"http:\/\/thomas.loc.gov\/\" target=\"_self\">THOMAS website<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Reuters reported that Majority Leader Harry Reid announced that the Senate aims to begin consideration next month, possibly by Marc 14, of a bipartisan bill to revamp the U.S. patent system and reduce the likelihood of what critics see as &#8220;excessive damage awards.&#8221;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_jetpack_memberships_contains_paid_content":false,"footnotes":""},"categories":[6,13,17],"tags":[],"jetpack_sharing_enabled":true,"jetpack_featured_media_url":"","jetpack_shortlink":"https:\/\/wp.me\/p2xROl-6R","_links":{"self":[{"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/posts\/425"}],"collection":[{"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/comments?post=425"}],"version-history":[{"count":0,"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/posts\/425\/revisions"}],"wp:attachment":[{"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/media?parent=425"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/categories?post=425"},{"taxonomy":"post_tag","embeddable":true,"href":"http:\/\/www.ipmetrics.net\/blog\/wp-json\/wp\/v2\/tags?post=425"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
