{"id":52,"date":"2010-12-14T12:15:48","date_gmt":"2010-12-14T19:15:48","guid":{"rendered":"http:\/\/ipmetrics.net\/blog\/?p=52"},"modified":"2010-12-14T12:15:48","modified_gmt":"2010-12-14T19:15:48","slug":"consumer-surveys-as-evidence-of-trademark-infringement","status":"publish","type":"post","link":"https:\/\/www.ipmetrics.net\/blog\/litigation\/case-law\/consumer-surveys-as-evidence-of-trademark-infringement\/","title":{"rendered":"Consumer Surveys as Evidence of Trademark Infringement"},"content":{"rendered":"<p>It is always important to take the pulse of your industry at the end of the year, delving deeper into important topics that were not urgent during the year but that gradually help shape your business practice. \u00a0 That is why we are glad to see IMS Expert Services&#8217; December issue of\u00a0<em><a title=\"IMS\" href=\"http:\/\/www.ims-expertservices.com\/newsletter-articles.htm\" target=\"_blank\">BullsEye<\/a> <\/em>reviewing the top ten cases of the year relating to expert witness testimony.<\/p>\n<p>In this post we highlight the &#8220;Delicious&#8221; case, which erupted whenVictoria\u2019s Secret began selling &#8220;a hot pink tank top with the word \u201cDelicious\u201d written in silver across the chest.&#8221; \u00a0Fortune Dynamic, the owner of the <strong>Delicious<\/strong> trademark for a line of footwear, brought suit against the lingerie company, only to have its complaint dismissed on summary judgment\u00a0after the trial<\/p>\n<p>court issued a ruling excluding the testimony of Fortune Dynamic\u2019s expert witness.<\/p>\n<p>As <em>BullsEye <\/em>explains, &#8220;&#8230;The expert witness conducted an online survey of young women to determine the <strong>likelihood of confusion<\/strong> between Fortune\u2019s footwear and Victoria\u2019s Secret\u2019s tank top. Based on the results of the survey, the expert concluded that there was a likelihood of confusion among consumers between the two products.<\/p>\n<p>The trial court ruled that this evidence was not reliable because the survey compared the two products side-by-side and failed to replicate real-world conditions.
